The now-infamous "backup" rule applies to *exact* copies with no change of media _at_all_. You are not entitled to own "backup" copies of games or any other such software as in most cases the company will supply you with it if needed (this is an industry standard POV, and is mentioned in the back of most manuals).
I remember a while back there was a very clear legality guide posted about this, and I wish someone would post it up again and end this stupid myth once and for all.
And while we're at it, lets mention that little point about sites linking to emulators etc. which demonstrates Nintendo's view on emulators themselves...

As requested, this is exactly what it says in the Eternal Darkness manual:

Copying of any Nintendo game is illegal and is strictly prohibited by domestic and international property laws. We oughtta know, we paid some damned big money to get it that way. Now, if you happen to be just backing up your own games, which if you paid for the game intellectual property law also says you therefore bought a license to it and so maybe the truth is the Court's would wind up siding with you instead of us, we'll just ignore you but keep telling everyone else it's illegal. And, if you have copies of games from our older systems like NES and SNES, we know the chances of getting the US attorney's office to prosecute you is just about nil, and sueing wouldn't do a lot of good either since we're not losing any profits...we don't even sell games for those systems anymore. So, we'll ignore you too,but it's still illegal, darnit. And if you set up a website that offers roms for download, then we'll call your ISP and scare the bejeezus out of them and you'll have to shut down your page. Daggonit. We mean business! We're not fooling around here!

that's as ridiculess as pretending we made that alpha and say we have all the right in the world to even expose the source if we so like..
because that's like saying.. "i am god".. a flat out lie that nobody believes..
the ridiculessness doesn't end there.. the bigger problem really i feel is that nothing to say otherwise has been pointed.. no real idea to why talking bout such a thing is unwanted.. if marty would tell me.. "i dun like it".. i'd be like.. "alright.. fair enugh.. i won't bugg you guys more bout it".. but as it is now.. it's been given the slip or excuse or whatever..
and vampi.. if you REALLY believe in what your saying yourself and aren't making excuses just to dimiss the idea and hope it goes away.. then honestly.. i'm wondering what your thinking
.. coz ppl would'nt bother so much with a topic like this if they didn't feel it was unfair.. ppl aren't stupid.. whatever you guys may think.. there is a point here.. sadly i feel i'm probably the last to still be nagging about this.. but i guess i'm stubborn .. so shot me..
