A woman in Baton Rouge, Louisiana is suing Nintendo for "unspecified damages" after her 30-year old son died during a marathon session on his N64. the unfortunate man died after hitting his head on a table during a seizure while playing with the console.

The man first started suffering seizures after buying his N64 in 1999, but he continued playing on the console for anything up to eight hours a day, six days a week, according to an AP report.

He played despite the now-standard epilepsy warning which comes with every Nintendo game. This informs players that "some people may have seizures or black outs triggered by light flashes, such as while .. playing video games, even if they have never had a seizure before".

The warning adds that "anyone who has had a seizure, loss of awareness, or other symptom linked to an epileptic condition should consult a doctor before playing a video game", and ends by suggesting in big capital letters that you should "stop playing immediately" if you experience any of these symptoms while using the console. It's also hard to see how the woman can seriously expect to sue Nintendo for "her son's lost future earnings" when he was a thirty year old who spent 48 hours a week sat in front of the TV playing Mario.

Nintendo denies any responsibility for the death, although in a similar case last year (also in Louisiana) a jury decided that the company "did not provide an adequate warning concerning the risk of seizures".

The jury did determine that the console in question (a SNES) "was not unreasonably dangerous in design". Which is nice to know.

I've even read warnings saying to take half hour breaks after playing for like an hour with my game cube. Wonder who sued Nintendo for what to cause them to put that in there...

Perhaps they included it to avoid lawsuits like these... And this is not a action specific to Nintendo or the gaming industry.

oh yeah i forget to say: that's d*mn funny. am i the only person who thinks that's funny? I especially like the note about the court finding the SNES "not unreasonably dangerous in design". I can put my hand on my heart and say my SNES has never injured me. It's never even looked at me funny.

ROFL. I'm sure your N64 is a little pissed at you for spending more time working on the PJ64 RDB than pushing its buttons. :p. J00 better watch your back. ;)

But of course, I laughed my arse of when I read it. :D

hmmm.. you know.. i used to play with my n64 far more than that guy.. i wonder how much i'll be playing when i get me a GC.. i suspect i'll die b4 i'm 25.. ok.. so who wanna brake the 30 year old record? :D.. i bet i can die from playing on a N console b4 25..

The guy is pathetic. 30 years old, living with mommy and playing Video Games all day. He was probably a rom begging whore too. :p I need more games for my V64JR! Mommy won't pay for them anymore! 30 years old... come on now. He had lazy society burden written all over him. I don't mean to be harsh or cold... but if he would have actually done something with his life, he wouldn't have has a seisure from the damn thing.

i remember passing out and falling on a glass frame after playing Lunar on my sega cd for 14 hours strate with not much to eat (sometimes i forget to eat when im on a game). well that shit cost me 27 stiches in my right arm. BUT I LIVED!!!!
