Give somebody the opportunity to exploit the court system and they will. IMO it needs a bit of reform. E.g. no more stupid activist judges changing the laws on the bench (democrats have frequently used this as a means of telling voters that their vote doesn't matter by throwing out ballot initiatives that get overwhelming voter approval,) and no more frivolous lawsuits.

Saying what laws are Constitutional and which ones aren't, as well as interpreting the laws, IS the job of the Courts.

Maybe if you got away from the conservative bullshit, such as the phrase "activist judges"...
