is there any way to use a pokemon gameboy game pak and a transfer pack on a Nintendo 64 emulator?
No, unless you have somekind of a backup unit that supports the Transfer Pak. The N-Rage input plugin emulates the Transfer Pak though, on a software level.

if you download the rom (which you can do legally if you own the original)
you can play that and use that on the game using nrages plugin.

Actually, you can't download a rom image legally, unless you pay for it from a licensed source.

as far as i know, current law states (where i am) that i must own the original cartridge to download roms of any kind, nintendo can't force me to remove what i already own,

In Australia, the law is the same as all the commonwealth countries (which include the UK), as in, you can not download from an unlicenced source for free even if you own 10 of the original cartridge. Only in countries like People's Republic of China is this not a crime.
